NOTICE IS HEREBY GIVEN THAT THE CITY COUNCIL OF THE CITY OF FATE WILL HOLD A SPECIAL CITY COUNCIL MEETING AT 6:00 P.M. ON TUESDAY, JULY 6, 2021 AT FATE CITY HALL, 1900 CD BOREN PARKWAY, FATE, TEXAS, FOR THE FOLLOWING PURPOSES:

PUBLIC COMMENT

This is an opportunity for the public to address the council on any matter, except public hearings that are included on the agenda. Comments related to public hearings will be heard when the specific hearing begins. Public comments are limited to three (3) minutes per speaker, unless otherwise required by law. To address the governing body, each speaker must complete a Public Comment Form and present the completed form to the City Secretary prior to the start of the meeting. Each speaker shall approach the podium and state his/her name and address before speaking. Speakers shall address the governing body with civility that is conducive to appropriate public discussion. Speakers can address only the governing body and not individual city officials or employees. The public cannot speak from the gallery but only from the podium. Per the Texas Open Meetings Act, the governing body is not permitted to take action on or discuss any item not listed on the agenda. The council may: (1) make a statement of fact regarding the item; (2) make a recitation of existing policy regarding the item; or (3) propose the item be placed on a future agenda.

CONSENT AGENDA

All items under Consent Agenda are considered to be routine by the City Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.

Approval of minutes of the Council meetings held June 7, 2021 and June 14, 2021.

B.

Approval of Ordinance No. O-2021-020- Granting To Sienergy, L.P. A FRANCHISE TO FURNISH AND SUPPLY GAS TO THE GENERAL PUBLIC IN THE CITY OF FATE, ROCKWALL COUNTY, TEXAS, AND TO TRANSPORT, DELIVER, SELL, AND DISTRIBUTE GAS IN AND OUT OF AND THROUGH SAID MUNICIPALITY FOR ALL PURPOSES; PROVIDING For The Payment Of A Fee Or Charge For The Use Of The Streets, Alleys, And Public Ways; And Providing A Severability Clause, A Penalty Clause, And An Effective Date.

Approval of Resolution No. R-2021-075- Approving The Fiscal Year 2022 Administrative/Operating and Emergency Management Budgets For The County Of Rockwall Emergency Services Corporation And Providing An Effective Date.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2021–021 - amending Fiscal Year 2020-2021 Budget: General Fund, Road Construction Fund, Capital Replacement Fund, General Fund Projects, Public Safety Fund, Parks Development District A, Parks Development District C, Fate Development Corporation, Parks Development Community, Utility Fund, and Storm Water Fund.

Conduct A Public Hearing And Discuss, Consider, and Take any Necessary Action regarding Ordinance No. O-2021-022- Related To The Williamsburg East Public Improvement District (Edgewater); Ratifying And Conforming Prior Actions Of The City Council In Connection With The District; Approving The 2021 O&M Annual Service Plan Update; Levying Assessments Against The Assessed Property To Pay For The Maintenance Of Authorized Improvements Within The District; And Making Certain Findings And Determinations Relating To The District.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2021-023 - Approving The 2021 Annual Service Plan Update To The Service And Assessment Plan, Including The Assessment Roll, For The Williamsburg East Public Improvement District (Edgewater).

Discuss, consider, and take any necessary action regarding Ordinance No. O-2021-024 - Approving The 2021 Annual Service Plan Update To The Service And Assessment Plan, Including The Assessment Roll, For Williamsburg Public Improvement District No. 1.

This is an amendment to an existing Planned Development for mixed use commercial and residential development) Discuss, consider, and take any necessary action regarding approval of an amendment to a Planned Development for Fate Village, a mixed-use commercial and residential development. The total project area is comprised of approximately 33 acres on the south side of I-30, west of Memorial Drive (FM 551), legal description: ABS A0208, D THEDFORD, TRACT 4-1, 32.2900 ACRES, City of Fate, Rockwall County, Texas. Case # ZR-21-001.

4) Discuss, consider, and take any necessary action regarding Ordinance No. O-2021-026- Amending The Comprehensive Zoning Ordinance And Changing The Zoning Classification On Approximately 32.79 Acres Of Land Generally Located On The South Side Of Interstate 30 Between FM 551 And The South Water Tower From A Planned Development District For Regional Mixed Use - Commercial (RMU-C) And Agriculture To A Planned Development District For Regional Mixed Use - Commercial (RMU-C) With Additional Development Conditions And Standards; Amending The Official Zoning Map; Providing A Penalty Not To Exceed Two Thousand And No/100 Dollars ($2,000.00) For Each Offense And A Separate Offense Shall Be Deemed Committed Each Day During Or On Which A Violation Occurs Or Continues; Providing For Savings, Severability, And An Effective Date.

EXECUTIVE SESSION: In accordance with Texas Government Code, Section 551.001, et seq., the City Council will recess into Executive Session (closed meeting) to discuss the following:

In accordance with Texas Government Code, Section 551.071, consultation with attorney on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act:

To receive legal advice regarding an ordinance to limit the location of dollar stores in the City.

RECONVENE INTO REGULAR SESSION: In accordance with Texas Government Code, Chapter 551, the City Council will reconvene into Regular Session to consider action, if any, on matters discussed in Executive Session

ADJOURNMENT

In addition to any executive session already listed above, the City Council of the City of Fate reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by Texas Government Code for the following purposes:
