NOTICE IS HEREBY GIVEN THAT THE CITY COUNCIL OF THE CITY OF FATE WILL HOLD A REGULAR CITY COUNCIL MEETING AT 6:00 P.M. ON MONDAY, MAY 3, 2021 AT FATE CITY HALL, 1900 CD BOREN PARKWAY, FATE, TEXAS, FOR THE FOLLOWING PURPOSES:

PUBLIC COMMENT

This is an opportunity for the public to address the council on any matter, except public hearings that are included on the agenda. Comments related to public hearings will be heard when the specific hearing begins. Public comments are limited to three (3) minutes per speaker, unless otherwise required by law. To address the governing body, each speaker must complete a Public Comment Form and present the completed form to the City Secretary prior to the start of the meeting. Each speaker shall approach the podium and state his/her name and address before speaking. Speakers shall address the governing body with civility that is conducive to appropriate public discussion. Speakers can address only the governing body and not individual city officials or employees. The public cannot speak from the gallery but only from the podium. Per the Texas Open Meetings Act, the governing body is not permitted to take action on or discuss any item not listed on the agenda. The council may: (1) make a statement of fact regarding the item; (2) make a recitation of existing policy regarding the item; or (3) propose the item be placed on a future agenda.

CONSENT AGENDA

All items under Consent Agenda are considered to be routine by the City Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.

Approval Of Resolution No. R-2021-062- Designating Signatories Of City Accounts; Designating Signatories Of Fate DPS Seizures Account; Superseding Any Previous Resolution And Providing An Effective Date.

ACTION ITEMS/PUBLIC HEARINGS

A.

Discuss, consider, and take any necessary actions regarding Resolution No. R-2021-063- approving an independent audit service proposal, selecting BKD CPAs & Advisors, LLP to perform independent auditing services for fiscal year ended September 30, 2021 with the option for each of the four subsequent fiscal years and authorizing City Manager to execute the engagement letter.

(This Application Is For A Special Use Permit (SUP) Zoning Application For A Vehicle Dealership Along I 30 Frontage Road) Discuss, Consider, And Take Any Necessary Action Regarding Approval Of Special Use Permit (SUP) Zoning Application For One Commercial Lot Along The I-30 Corridor. The Current Lot Contains A Total Area Of 1.75 Acres On The North Side Of I-30, Three Lots West Of The Ben Payne And I-30 Frontage Rd Intersection In The R.B. Irvine Survey, Abstract No. 120, City Of Fate, Rockwall County, Texas. The SUP Is Requested To Be Added Onto The Existing Highway Commercial Zoning In Order To Fulfill The Zoning Requirements For Specialty Vehicles, Used. Applicants: Fate LSI LLC And TJ Riley Of Net Direct Autos. Case # SUP-21-001

4) Discuss, consider, and take any necessary action regarding Ordinance No. O-2021-010 - Amending The Comprehensive Zoning Ordinance By Approving A Special Use Permit For “Motor Vehicle Sales, Used” To Authorize Used Auto Sales On Property Located At 2465 E I-30, Cad Property Id 54190; Amending The Official Zoning Map; Providing A Penalty Up To $2,000 Per Day; Providing For Savings, Severability, And Declaring An Effective Date.

(This Item Is To Discuss Amending The Accessory Building Ordinance) Discuss, Consider, And Take Any Necessary Action Regarding Amendments To Ordinance O-1789, “Article IV – Use Standards” Section 4.3.5 General Standards For All Accessory Uses And Structures.

3) Discuss, consider, and take any necessary action regarding Ordinance No. O-2021-011- amending Chapter 36 (Unified Development Ordinance), Article IV (Use Standards), Section 36-4.3 (Accessory Uses And Structures) Of The City Of Fate Code Of Ordinances By Clarifying Subsections 36-4.3.5(1)(c)i–ii, Adding Awning Regulations Under Subsection 36–4.3.5(1)(c)iv, Adding Separation Requirements Under Subsection 36-4.3.6(1)(d)iv; Providing For A Penalty, Savings, Cumulative/Repealer, Severability Clause And An Effective Date.

EXECUTIVE SESSION: In accordance with Texas Government Code, Section 551.001, et seq., the City Council will recess into Executive Session (closed meeting) to discuss the following:

In addition to any executive session already listed above, the City Council of the City of Fate reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by Texas Government Code for the following purposes:
